What this bill is about
The Genocide Determination Bill [HL] is a Private Members’ Bill that would require (or seek to require) the High Court and the Court of Session in Scotland to make preliminary decisions about whether genocide, or a serious risk of genocide, exists under the UN Genocide Convention. It would also seek to provide for passing those determinations to relevant international courts or organisations and for responses to reports of genocide, plus related matters.
What it would do
- Would seek to have the High Court (England and Wales and Northern Ireland) and the Court of Session (Scotland) make preliminary genocide determinations.
- Would seek to cover both genocide and a serious risk of genocide under the Convention on the Prevention and Punishment of the Crime of Genocide.
- Would seek to provide for referring such determinations to relevant international courts or organisations.
- Would seek to provide for responses to reports on genocide, with connected provisions.
