The Highways (Financing) Bill would create a framework for private companies to finance, build, operate and maintain specified trunk roads in England. Licensed companies could charge tolls for using those roads, subject to regulation and conditions. The Office of Rail and Road would have a role in regulating licence holders, including monitoring performance, overseeing charges and enforcing requirements. The Bill would also provide arrangements for toll enforcement, the transfer of highway functions and assets, and the continued operation of a road if its licence holder became insolvent.
What it would do
- Allow licences for companies to charge tolls in return for delivering or maintaining specified trunk roads in England.
- Give licensed companies certain highway and traffic authority functions for roads covered by their licences.
- Provide for the Office of Rail and Road to regulate licence holders, including monitoring, enforcement and penalties.
- Create arrangements for collecting and enforcing tolls, including penalty charges and appeals.
- Establish a special administration regime to help maintain road services if a licence holder becomes insolvent.
