What this bill is about

The Immigration and Asylum Bill would overhaul parts of the immigration and asylum system, including setting up a new Independent Immigration Appeals Authority (IIAA) to handle certain immigration, asylum and human-rights appeals, and bail-related appeals. It would also change how Article 8 (family and private life under the European Convention on Human Rights) is considered in immigration decisions. In addition, it would make reforms linked to modern slavery, including support and victim-related processes, and introduce provisions on asylum support costs and on how “protection” claims are defined.

What it would do

  • Create a new Independent Immigration Appeals Authority (IIAA) to decide specified immigration, asylum and human-rights appeals and certain bail-related functions.
  • Set out who will sit on the IIAA, require an IIAA procedure rules framework, and allow rules on time periods and case-handling.
  • Change how Article 8 family or private-life claims are made and assessed in immigration decisions, including defining family life and public-interest considerations.
  • Reform modern slavery-related processes, including prevention/risk order measures and parts of victim identification and support rules, including disqualification from protection.
  • Provide for asylum support cost recovery and introduce a combined definition of “protection claim” (refugee status and humanitarian protection).
