What this bill is about

The National Security (State Threats) Bill would amend the National Security Act 2023 to allow the Secretary of State to designate bodies involved in “foreign power threat activity” by regulations, and to remove designations. It would also create offences connected to designated bodies, including supporting a designated body for a “prohibited purpose”, materially assisting a designated body’s UK-related activities, and obtaining (or accepting/agreeing to accept) certain material benefits provided by or on behalf of a designated body. The Bill would include arrangements for designated-body designations and related matters through regulations and consequential changes.

What it would do

  • Allow the Secretary of State to designate (and remove designations of) bodies involved in foreign power threat activity, using regulations.
  • Create offences where a person supports a designated body for a prohibited purpose.
  • Create offences where a person intends to materially assist a designated body’s UK-related activities, and certain related conduct.
  • Create offences involving obtaining or accepting non-excluded material benefits provided by or on behalf of a designated body.
