What this bill is about
The Courts and Tribunals Bill makes changes to parts of the criminal courts system in England and Wales, including how defendants’ mode of trial is decided, when judge-only trials can be used, magistrates’ sentencing powers, and rules on evidence in sexual offence cases and special measures for witnesses. It also reforms leadership arrangements for tribunals, removes a presumption about parental involvement in certain children cases, and makes other provisions about courts and tribunals, including matters relating to the Crown Court in the City of London.
What it would do
- Change criminal court procedures on trial mode, including removing a right to elect trial on indictment for certain offences.
- Create circumstances for judge-only Crown Court trials and introduce/adjust related court and sentencing procedures.
- Tighten rules on admitting evidence in sexual offence proceedings and adjust special measures available to eligible witnesses.
- Amend Children Act 1989 decision-making by repealing the presumption of parental involvement in a child’s life.
- Reform leadership of tribunals and make other provisions including magistrates’ expenses and a specific Crown Court arrangement in the City of London.
