The Cyber Security and Resilience (Network and Information Systems) Bill would update the UK’s Network and Information Systems (NIS) regime by extending it to more types of organisations, strengthening incident reporting, and improving how regulators enforce and manage compliance. It would amend the existing NIS Regulations 2018 and add powers for the Secretary of State and regulatory authorities to set expectations, make future changes, and issue directions for national security purposes. It also sets out arrangements for information sharing, cost recovery, and enforcement, including penalties.
What it would do
- Amend the NIS Regulations 2018 to broaden which providers are regulated, including data centre operators and certain service providers.
- Expand and reshape incident reporting requirements, including notifying regulators quickly and later providing fuller reports.
- Create and use “critical supplier” designations, where disruption could significantly affect essential or digital services.
- Give the Secretary of State and regulators functions such as setting strategic priorities, issuing directions, and strengthening information gathering and enforcement.
